In a case brought by the Ohio Attorney General’s Office at the request of Ohio EPA, a Summit County judge has ordered the owner of CountryView South Apartments in Green to abandon his drinking water and sewage treatment facilities, connect to municipal drinking water and sewer, and pay a minimum $50,000 penalty. Generic for imitrex: summit County Court of Common Pleas Judge Robert Gippin sided with the State and ordered the improvements after defendant Joel Helms repeatedly violated Ohio’s safe drinking water and water pollution control regulations at his 34-unit apartment complex located at 5001 Massillon Road.
The judgment is the latest ruling in an eight-year legal effort to force CountryView to comply with Ohio’s regulations. Generic for imitrex: on numerous occasions during that time, the drinking water provided to tenants was contaminated because Helms failed to properly treat the water with chlorine, test to ensure the water was safe to drink, and notify residents of the problems.Judge Gippin found CountryView’s residents were placed at substantial risk by Helms’ conduct.
In addition, CountryView’s on-site sewage treatment system repeatedly discharged partially-treated sewage to nearby wetlands.Helms admitted to dredging, installing pipes and berms, depositing fill, and intentionally discharging the partially-treated sewage.
Judge Gippin’s ruling gives Helms 90 days to abandon his drinking water system and connect to the Aqua Ohio water main located under Massillon Road and 120 days to abandon the present wastewater treatment system and connect to the publicly-owned treatment system also under Massillon Road.Once connected, Helms must decommission his sewer system, clean it up, and properly dispose of remaining sludge and waste; generic for imitrex.He also must submit a wetland restoration and enhancement plan and immediately implement it upon Ohio EPA’s approval.
Should Helms fail to follow Judge Gippin’s ruling, his $50,000 penalty for the water pollution violations could go as high $500,000.A January 8, 2009 court trial has been set to consider additional civil penalties for the drinking water violations.
