Chief Justice Thomas J. Moyer of the Supreme Court of Ohio today issued a statement calling on Ohio attorneys to offer their services pro bono (without charge) to assist courts, homeowners and lenders in addressing the increasing number of foreclosure cases filling Ohio court dockets.
“This is more than a legal issue; this is a social issue,” Chief Justice Moyer told a group of more than 20 leaders from the legal community gathered at the Ohio Judicial Center for a meeting on the problem. “People’s lives are being seriously affected, and the legal community must respond with action.”
In attendance at Thursday’s meeting were Ohio Treasurer Richard Cordray, Gov. Ted Strickland’s Chief Legal Counsel Kent Markus, and representatives from Attorney General Marc Dann’s office, the Ohio State Bar Association, the Equal Justice Foundation, the Ohio Legal Assistance Foundation, the Ohio State Legal Services Association, the Coalition on Homelessness and Housing for Ohio, and the Legal Aid Society of Southwest Ohio.
The group created several working groups that will meet separately over the coming weeks and report specific action plans early next year, including a communications program for connecting borrowers, lenders and pro bono attorneys.
“Today I call on all attorneys in Ohio who are qualified to assist in matters related to foreclosure filings. In particular, we are in need of attorneys to assist in mediating these disputes because a concerted mediation effort offers the promise of making a real difference,” the Chief Justice said. “Attorneys have a professional obligation to perform pro bono service, and this is one area where there is significant unmet need.”
The Court and its partners will be working to develop programs to train attorneys with limited or no foreclosure experience to also offer their services.
Mark Lawson, of the Legal Aid Society of Southwest Ohio, estimated that services provided by his organization’s attorneys have saved as many as 400 homes in 2007. “We need more attorneys to step forward and help,” Lawson said.
Foreclosure filings are expected to rise more than 40 percent in Ohio this year compared to four years ago. According to data supplied to the Supreme Court by the common pleas courts, 85 of 88 counties have experienced increases when comparing projected 2007 figures to those recorded in 2003. Only Meigs, Pike and Putnam counties are expected to have decreases. The Coalition on Homelessness and Housing for Ohio estimates that some 87,000 homeowners in Ohio face imminent foreclosure. The coalition’s executive director, Bill Faith, said that with thousands of loans with adjustable rates expected to be reset in the coming months, foreclosure rates will likely continue to increase well into 2011.
“To anyone who wants to make a difference in the world, this is a defining issue of our time,” said Treasurer Cordray. “A well-organized, coordinated, statewide approach is needed to address this crisis, which is unfolding on an enormous scale.”
The Supreme Court of Ohio is working with common pleas courts in Franklin, Cuyahoga and Montgomery counties on pilot projects to offer mediation between lenders and homeowners to avoid foreclosure when possible. The pilot projects will develop flexible models to facilitate similar programs for responding to the foreclosure problem statewide.
The Court issued a statement in September re-affirming a Statement on Professionalism that recognized each lawyer’s obligation to engage in activities that promote the common good, including the provision of and support for pro bono representation to indigent clients. That principle is included in a new Court publication, “The Supreme Court of Ohio Professional Ideals for Ohio Lawyers and Judges.”

To measure and maintain the strength and growth of this unaffordable economy and prove that only money has value.
Pay sales tax and for meth with welfare checks.
Pay for the more stock dividends (money) Hillarys (money marketers) market quarterly in the wholesale and retail price of food with food stamps.
Pay property tax and interest on lottery winner’s winnings legislators invest in school bonds with housing vouchers.
Pay for the more stock dividends (money) Hillarys (money marketers) market quarterly in the wholesale and retail price of prescription drugs and health care with Medicaid.
With money derived from wages or independent business profit.
Supports the demise of Natural Law, God, democracy, capitalism, the US Constitution, and free, fair, and affordable commerce. Makes funding schools IMPOSSIBLE; Makes free, fair, and affordable commerce IMPOSSIBLE. Makes balancing every budget IMPOSSIBLE. Makes union workers, consumers, taxpayers, and America’s grandchildren’s children LIFE UNAFFORDABLE. And created the $40 trillion social security and the $8.6 trillion national debt. America’s grandchildren’s children are responsible to pay interest with until they are 18 years old.
Then pay the debt with the $6.85 per hour labor wage. Twenty five percent of We the stupid, defiant of demands of natural law (what Mother Nature, God, or Whatever Power decreed to be the reality of the real world) God, democracy, capitalism, the US Constitution, and free, fair, and affordable commerce. Deceived in Sunday schools, public schools, private schools, and home schools, colleges, and universities government of the people, by the people, for the people, elected legislators and representatives to enact.
There is no reason to believe America’s grandchildren’s children that go to bed hungry can afford life and pay this debt with money derived from wages or independent business profit in a hundred million years.
